HUMAN RIGHTS COMMISSION ADMITS AND ORDERS URGENT HEARING BEFORE DIVISION BENCH : PETITION OF 26/11 VICTIMS

Human Rights Commission today admitted and gave priority to the petition of victims of 26/11.  The Chairman justice Kshitij Vyas admitted Dr. Kirit Somaiya’s petition regarding relief & rehabilitation of 26/11 victims and ordered Home Ministry Maharashtra, Rehabilitation Secretary Maharashtra, Commissioner of Police & Divisional Railway Manager, Central Railway, to file response in 4 weeks.  Chairman also ordered that the petition will be heard by the bench of Dr Kshitij Vyas, Chairman & Mr.Suresh Lala, Member.  Several victims & relatives were also present along with Dr. Kirit Somaiya.

Suffering of the victims and their families of 26/11 has begun.  They are forced to approach 10 to 12 different Agencies.  BJP leader, Dr. Kirit Somaiya filed a Petition today with the Human Rights Commission to intervene and issue directives to various Departments, Government agencies to complete the claims, compensation work in 3 months. 

Victims are facing various hardships – 

1.    Even though one month has passed, they are struggling to get Death Certificate, Post Mortem Report, etc.

2.    State Government, Collectorate have started showing apathy and refusing the victims to get claim of Rs.3 lacs from Home Ministry, Government of India and Rs.2 lacs from PMO.  

Multiple Agencies, 12 required to be approached.  Lack of coordination – 

1.    Hospitals for Postmortem Report 

2.  Mumbai Police for FIR                            

3.  Anti Terrorism Squad                            

4.  Railway                                            

5.  Railway Claims Tribunal                           

6.  Maharashtra Govt. for Rs.5 lacs compensation  

7.  Home Ministry, GOI for Rs.3 lacs compensation

8.  PMO for Rs.2 lacs compensation

9.  Certificate from Hospital

10. Collectorate for submitting the claim

Medical treatment – difficult to get proper treatment. 

Dr. Kirit Somaiya along with few victims approached the Human Rights Commission today afternoon and filed the 84-page Petition with HRC.  The Petitioner prayed for directives : 

1.    Immediate withdrawal of illegal, immoral GR of Rehabilitation Dept. on compensation of Rs.25 lacs to Police

2.    Appointment of Nodal Minister and Nodal Secretary to act as a single window for all relief and rehabilitation work so that victims/relatives are not required to move from pillar to post.

3.    Arrangement by various Govt. agencies including Rehab. Ministry, Home Ministry, Collectorates, Railway, PMO to submit the compensation, etc. to victims/families.

4.  Govt. of Maharashtra to coordinate for financial compensation of PM fund, Home Ministry’s scheme, make available cheques, bank credit directly to the victims as all paper work has been completed for Govt. of Maharashtra’s Rs.5 lac compensation.

5.    Senior Govt. Officer to collect all necessary certificates (death certificate, Post Mortem Report, copy of FIR, etc.) from the agencies and make available to the victims/families.

6.    Special arrangement to be made to make available best medical treatment to the bullet injury victims

7.    Inquiry into handing over body of Manohar Sahani to unknown person instead of to his father.

8.    Provide healing touch to the relief and rehabilitation work.
