SUPREME COURT’S CEC SYMPATHETIC ABOUT 4.5 LAC

RESIDENTS OF PRIVATE FOREST

The Central Empowerment Committee, during its hearing on 11th November at Delhi, expressed concerned at the plight of 4.5 lac honest, innocent residents whose houses have been declared as Private Forest.  The Committee asked Dr. Kirit Somaiya, ex Member of Parliament, to submit further details about the residential societies, housing complexes, houses on such land residing for 5 to 55 years.

The Central Empowerment Committee, chaired by Mr. P.V. Jayakrishnan and members      Mr. Mahendra Vyas, Mr. S. K. Patnaik, Mr. Mohanty, Mr. S. K. Chada, Mr. Maharaj Kishan Muttu, Mr. M. P. Jivrajika – Member – Secretary, gave patient and long hearing to Dr. Somaiya, enquired and interacted in detail about the status and solution.  Dr. Somaiya explained in detail that without any fault of residents, they have to suffer.

It is shocking that, in spite of repeated suggestions from the Empowerment Committee, Government of Maharashtra remained adamant, opposed the proposal to protect the 4.5 lac residents.  Government of Maharashtra was represented by its officials, Mr. Jwala Prasad, Mr. Dange and Mr. Mangrulkar – Secretaries of its Forest Department.

The Committee was positive about Dr. Somaiya’s request to exempt all these 4.5 lac residents spread over 3700 buldings from the Forest.  Supreme Court may be requested to exempt them at one stroke/one order. Government of Maharashtra consistently opposed the same.

Dr. Somaiya, local Municipal Councillor, Mr. Manoj Kotak and Housing Societies representative, Ms. Girija Balakrishnan made detailed presentation before the Committee about the plight of the innocent residents.

In conclusion, CEC expressed its opinion that the issue of 4.5 lac innocent residents be separated from others.  They should be spared and given relief at one stroke.  All those properties which were occupied legally prior to the Mumbai High Court order of 2005 be provided relief at one stroke.

The hearing was also attended by legal representatives of various builders and developers.  Their issue will be taken up separately by CEC on 25th November.
